The New Income Tax Law

Cash transactions are also confusing in the family circle, with many questions about income tax implications. Whether it is about helping your son with a gift or sharing the cost with your spouse, knowing boundaries becomes essential. Let us now go into the rules and exceptions on cash transactions between relatives in India.

Under the Scrutiny of the Income Tax Department?

Cash movements are among the financial transactions that are monitored by the Income Tax Department. But non-business cash transfers for household costs or gifts between husbands and wives are nontaxable to the recipient. These sums are still under the husband’s income and therefore, a tax notice would not be related to these amounts.

Beware of Investment Income:

The rule changes if the cash received is reinvested to earn income for the wife. In these situations, the wife’s taxable income is investment income multiplied by the year-on-year ratio.

The Threshold Limit and Penalty Zone:

Cash transactions exceeding ₹20,00 are subject to penalties set out in sections 269SS and 269T of the Income Tax Act. However, this rule comes with significant exemptions:

  • Transactions involving

Transactions between parents and children, as well as spouses, are exempt from the limit of Rs.20,000 and do not attract any penalties. This offers flexibility in terms of familial support and financial aid.

  • Other near relatives

Such as brothers and sisters, grandparents and grandsons also get exemptions under certain conditions. These exemptions provide families with the opportunity to run their shared finances without tax complications.

Beyond the Exemptions: Maintain Transparency and Records

Although exemptions are provided for cash transactions among close family circles, it is essential to keep transparency and documentation. Recording the reason and motive for cash transactions of over ₹20,00/- although exempt from scrutiny by the Income Tax Department provides an additional layer of safety against potential questioning in case there is a discrepancy.

Additional Considerations:

  • The purpose and nature of the cash transaction (gift, household spending, etc.) should be clarified.
  • Keep records of transactions using receipts, bills or written contracts.
  • Remember the special rules that apply to close relatives other than immediate family members.
  • If there are any doubts, contact a financial advisor or tax specialist for specific advice.

With knowledge of the provisions and exceptions for cash transactions within families, you will learn how to handle your finances properly without having unnecessary worries about tax consequences. However, it is important to remember that responsible record-keeping and transparency are still necessary for any smooth and compliant relationship with the Income Tax Department.
